fa بررسی جایگاه اخلاق و قوانین در مراقبت‌های دارویی و بهداشتی علوم پایه Basic Sciences مقاله پژوهشی Orginal Research <div style="text-align: justify;"><span style="font-size:14px;"><span style="font-family:nasimYW;"><span style="line-height:normal"><span style="direction:rtl"><span style="unicode-bidi:embed"><span new="" roman="" times=""><b><span b="" nazanin="">مقدمه: </span></b><span b="" nazanin="">با توجه به اهمیت بهداشت و حمایت از حقوق بیماران روشن است پرداختن به جایگاه و رابطه اخلاق در ضمن قوانین موضوعه در راستایی مراقبت‌های دارویی و بهداشتی از ارزش و جایگاه ویژه‌ای برخوردار می‌باشد؛ بنابراین هدف از مطالعه این پژوهش نقد و بررسی جایگاه اخلاق پزشکی و آثار و ارتباط آن با تدوین قوانین در حوزه مراقبت‌های دارویی وبهداشتی می‌باشد.</span></span></span></span></span><br> <span style="line-height:normal"><span style="direction:rtl"><span style="unicode-bidi:embed"><span new="" roman="" times=""><b><span b="" nazanin="">روش کار:</span></b><span b="" nazanin=""> مراقبت‌های دارویی و بهداشتی به عنوان یکی از اساسی‌ترین و کلیدی‌ترین مباحث و مسائل موجود در حوزه درمان وحقوق سلامت به شمار می‌آید؛ حال جامعه و دولت‌ها وظیفه دارند به منظور تأمین امنیت لازم در حوزه بهداشت و مراقبت‌های دارویی به تدوین و تنظیم قواعد، مقررات تامینی و تضمینی مبتنی با اخلاق و ارزش‌های حاکم بر جامعه بپردازند؛ لذا در این تحقیق با استفاده از رویکردی توصیفی- تحلیلی با بررسی منابع و مطالعات کتابخانه‌ای در حوزه تألیف و مطالعات صورت گرفته در حوزه اخلاق پزشکی تلاش شده است به نقد، مطالعه و بررسی مبانی و قواعد موجود در حوزه اخلاق پزشکی و مراقبت‌های دارویی و بهداشتی بپردازیم.</span></span></span></span></span><br> <span style="line-height:normal"><span style="direction:rtl"><span style="unicode-bidi:embed"><span new="" roman="" times=""><b><span b="" nazanin="">یافته‌ها:</span></b><span b="" nazanin=""> بنابر آنچه بیان شد می‌توان از مهمترین دستاوردها و یافته‌های این پژوهش به نقد جایگاه اخلاق در تدوین قوانین و مقررات در حوزه مراقبت‌های دارویی وبهداشتی با توجه به درک مبانی حقوقی و حاکم در حوزه اخلاق پزشکی به عنوان یکی از مطالعات و یافته‌های مورد بحث این پژوهش در حوزه مراقبت‌های دارویی و بهداشتی اشاره کرد؛ که همانگونه که در ضمن پژوهش پیشروی به آن اشاره کردیم سعی و تلاش شد که پس از بررسی و بحث در رابطه با هر یک، ضمن نقد تعاملات و آسیب‌های موجود در حوزه اخلاق حرفه‌ای به درک روشن و مقتضی از ضرورت‌های موجود در حوزه اخلاق پزشکی و مراقبت‌های دارویی و بهداشتی دست یابیم. سیاست تقنینی حاکم در بحث مراقبت‌های دارویی و بهداشتی به صورت کلی و بدون رعایت ضوابط و قواعداخلاقی در چند دهه و با اصرار به جرم انگاری برخی از امور و فعالیت‌ها تدوین و تنظیم گردید و تا به امروز متاسفانه هیچ گونه تلاش تخصصی در باب تبیین و شناسایی مسئولیت، حدود و شرایط مسئولیت در حوزه مراقبت‌های دارویی و بهداشتی به صورت جدی و تخصصی صورت نگرفته است. و در پایان با درک و بررسی کاستی‌ها و مبانی حاکم بر نظریه‌ی نتیجه گرایی اخلاقی در حوزه سلامت و مراقبت‌های دارویی وبهداشتی با واقعیت‌های اجرایی و قانونی موجود در بحث به نقد، مطالعه و بررسی مبانی و قواعد حاکم در حوزه حقوق سلامت و اخلاق پزشکی به نتیجه گیری بحث بپردازیم.</span></span></span></span></span><br> <b><span dir="RTL" lang="AR-SA"><span style="line-height:107%"><span arial="">نتیجه گیری:</span></span></span></b><span dir="RTL" lang="AR-SA"><span style="line-height:107%"><span arial=""> در مطالعه حاضر نشان داده شد که به اندازه کافی در ضمن تدوین قوانین و مقررات و ترسیم سیاست اجرایی و قانونی در قالب مراقبت‌های دارویی و بهداشتی آنچنان که می‌بایست به جایگاه نظامات اخلاقی و قانونی توجه ای نشده است؛ از این روی به نظر می‌رسد ضمن تلاش برای شناخت الگوی اخلاقی حاکم برجامعه جای دارد قوانین و مقررات در حوزه مراقبت‌های دارویی و بهداشتی متناسب با اخلاق بازنگری‌های لازم به عمل آید.</span></span></span></span></span></div> <div style="text-align: justify;"><span style="font-family:Arial;"><span style="font-size:14px;"><span lt="" optima="" std=""><b>Introduction:</b> Considering the importance of health and protection of patients&#39; rights, it is clear that addressing the status and relationship of ethics in addition to the relevant laws in the direction of medical and health care has a unique value and quality; Therefore, the purpose of studying this study is to critique the status of medical ethics and its effects and its relationship with the development of laws in the field of medical and health care.</span><br> <span style="line-height:107%"><span calibri=""><b><span style="line-height:107%"><span lt="" optima="" std="">Method:</span></span></b><span style="line-height:107%"><span lt="" optima="" std=""> Pharmaceutical and health care are one of the most fundamental issues in the field of treatment and health rights; Now, to provide the necessary security in the area of health and pharmaceutical care, the society and governments have to formulate and regulate rules, security and guarantee rules based on ethics and values governing the community; therefore, in this research, using a descriptive approach- Analytical By examining the sources and library studies in the field of authorship and studies in the field of medical ethics, we have tried to critique, study and review the principles and rules in the field of medical ethics and pharmaceutical and health care.</span></span></span></span><br> <span style="line-height:107%"><span calibri=""><b><span style="line-height:107%"><span lt="" optima="" std="">Results:</span></span></b><span style="line-height:107%"><span lt="" optima="" std=""> Based on what has been stated, one of the most significant achievements and findings of this research can be the critique of the position of ethics in formulating laws and regulations in the pharmaceutical and health care field according to understanding the legal principles in the field of medical ethics. The topics discussed in this study were in the field of pharmaceutical and health care; As we mentioned in the progressive research, after reviewing and discussing each of them, we tried to critique the interactions and harms in the field of professional ethics to a clear and appropriate understanding of the needs in the field of medical ethics. And access to medical and health care.
